DISCOUNT CARD TERMS AND CONDITIONS

This Discount Card Terms and Conditions (this “Discount Card Policy”), together with our Privacy Policy and Terms of Service (https://www.togethxr.com/pages/privacy-policy) (the “Privacy Policy,” and together with this Discount Card Policy, the “Terms”), applies to use and redemption of physical discount cards issued by TOGETHXR (as defined below) for use on TOGETHXR’s e-commerce website. By accepting or using a TOGETHXR Discount Card (“Discount Card”), you agree to these Terms, as they are updated from time to time. If you do not agree, do not accept or use the Discount Card. To the extent of any conflict between this Discount Card Policy and the Privacy Policy, the terms of this Discount Card Policy shall control to the extent to resolve the conflict.
1. Parties.
This Discount Card Policy is a legally binding agreement between you, the consumer (“you” or “your”), and us. We use the terms “us,” “we,” and “our” to collectively refer to AXM, LLC (d/b/a TOGETHXR) (“TOGETHXR”) and all of TOGETHXR’s parents, subsidiaries, representatives, affiliates, officers, directors, employees, and agents.
2. Redemption.
TOGETHXR is the issuer of the Discount Cards, which are redeemable only as described in these Terms. The Discount Card is a physical Discount Card containing a unique code which may be redeemed only for eligible merchandise purchases on our website located at: https://www.togethxr.com/pages/shop.
To redeem, enter the Discount Card code at checkout. The available balance will be applied to your order total. Discount Cards are not valid for in-store purchases or through third-party retailers.
3. No Expiration; No Fees.
This Discount Card does not have an expiration date. Further, this Discount Card is not subject to any inactivity, service, or maintenance fees.
4. Remaining Balances; Taxes & Shipping.
If your purchase exceeds the Discount Card balance, you will be responsible for paying the remaining amount using another accepted payment method. If your purchase is less than the balance, the remaining value will not be available for future use.
The discount applies only to merchandise and does not include shipping, taxes, or other fees unless expressly stated.
5. Risk of Loss; Lost, Stolen, or Damaged Cards.
This Discount Card should be treated like cash. The risk of loss and title for the Discount Card will pass to the purchaser or recipient upon delivery. TOGETHXR is not responsible for lost, stolen, damaged, or unauthorized use of the card or its code. You are responsible for safeguarding the code and its code. Except as required by law, lost, stolen, or damaged Discount Cards will not be replaced or refunded.
6. Returns and Refunds.
Purchases made with a Discount Card are subject to TOGETHXR’s return policy available at: https://www.togethxr.com/pages/return-policy.
7. Use Restrictions.
Discount Cards are not redeemable for cash. You may not resell or transfer a Discount Card for value without TOGETHXR’s permission. Additionally, Discount Cards may not be used for unauthorized, illegal, or fraudulent purposes.
The discount cannot be combined with other offers, promotions, or codes unless permitted by TOGETHXR. A Discount Card is valid only for one-time use/single transaction, unless otherwise stated. TOGETHXR may exclude certain products or categories from this discount in its sole discretion.
TOGETHXR reserves the right to refuse, cancel, or suspend Discount Cards or transactions in the event of suspected fraud, misuse, or violation of these Terms.
8. Modification of Terms.
TOGETHXR reserves the right to modify these Terms at any time, to the extent permitted by law. For the avoidance of doubt, these terms apply to purchased Discount Cards only. Gift cards and promotional cards may be subject to separate terms.
9. Disclaimer of Warranties; Dispute Resolution; Limitation of Liability.
Discount Cards are provided “as is” and without warranties of any kind, except as required by law. These terms are intended to comply with applicable consumer protection laws. All issues concerning the construction, validity, interpretation and enforceability of this Discount Card Policy will be governed by and construed in accordance with the internal laws of the State of New York without giving effect to any choice of law or conflict of law, rules, or provisions that would cause the application of any other laws, and subject to applicable consumer protection laws. UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, INDIRECT, EXEMPLARY, CONSEQUENTIAL, SPECIAL, LOST PROFITS, LOSS OF USE OR DATA OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00). YOU IRREVOCABLY WAIVE ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. THE FOREGOING LIMITATATIONS APPLY REGARDLESS OF THE CAUSE OR FORM OF ACTION (WHETHER BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE). You agree that all disputes relating to or arising out of this Discount Card Policy shall be submitted to the American Arbitration Association (“AAA”) for arbitration before a single arbitrator, who shall be a retired judge, in accordance with the rules of the AAA then in force and effect as the sole exclusive remedy for resolving such controversies. The parties agree that the decision of the arbitrator shall be final and binding and that a judgment may be entered on such arbitration or in any court of competent jurisdiction. The parties agree any such arbitration shall take place in Los Angeles, California. The prevailing party in any such arbitration shall be entitled to recover its costs and expenses, including reasonable attorneys’ fees.
10. General.
If any part of this Discount Card Policy is not valid or enforceable, then that provision shall be deemed severable, meaning it will not affect the validity or enforceability of any remaining provisions. If you do not comply with this Discount Card Policy, and we do not act right away, that does not mean we are giving up any rights now or in the future. In this Discount Card Policy, the section headings are used for reference and convenience only and are not legally binding.
